Terms and Conditions of Sale

These terms govern your use of www.halalplug.com and any order you place with us. Please read them before ordering. By placing an order you agree to them.

These terms do not affect your statutory rights as a consumer. Where anything here conflicts with UK consumer law, the law prevails.

1. Who we are

This website is operated by HALAL PLUG LTD, trading as HALAL PLUG, a company registered in England and Wales under company number 15875444, with its registered office at 178 Merton High Street, London, England, SW19 1AY.

HALAL PLUG LTD is not currently registered for VAT, so no VAT is charged on your order.

In these terms, "we", "us" and "our" mean HALAL PLUG, and "you" means the person placing the order.

2. Who can buy from us

You must be at least 18 and legally able to enter into a contract. Our products are collectible trading card products and accessories; they carry the manufacturer's own age guidance on the packaging, which you should follow.

We sell to consumers. If you are buying in the course of a business, the consumer rights described in these terms and in our Returns and Refunds Policy do not apply to you, and we may decline or limit your order.

3. How a contract is formed

This matters, so we set it out plainly:

1. Placing an order is an offer to buy. It does not create a contract.
2. The confirmation email we send when you order acknowledges receipt. It is not acceptance.
3. A contract is formed only when we dispatch the goods, and only for the goods actually dispatched.

If we cannot accept your order — because an item is out of stock, because our allocation has been reduced, because of a pricing error, or because the order fails our fraud checks — we will tell you and refund any payment in full. We will not charge you.

4. Products, availability and allocation

We describe our products as accurately as we can and use images that fairly represent them. Screen colours vary, and manufacturer packaging artwork sometimes changes between print runs.

Sealed trading card product is randomised by the manufacturer. We have no control over, and make no representation about, the cards contained inside sealed product. We do not weigh, search, open or otherwise interfere with sealed product.

We do not sell our products as graded or guaranteed mint-condition packaging unless a listing expressly says so. Minor shelf wear to outer packaging is normal for sealed product and is not a defect.

Stock is limited and some releases are subject to manufacturer allocation.

5. Prices and payment

Prices are in pounds sterling. We are not currently VAT registered, so no VAT is added. Delivery charges are shown separately and in full at checkout before you pay, and there are no unavoidable fees added after that point.

We take payment when you place your order. Payment is processed by Shopify Payments and other providers offered at checkout; we do not receive or store your full card details.

Pricing errors

If we discover an error in the price of goods you have ordered, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund. If the pricing error is obvious and could reasonably have been recognised by you as a mispricing, we may cancel and refund you without supplying the goods.

6. Fraud prevention and order screening

We screen orders for indicators of fraud. We may ask you to verify your identity or the payment method before we dispatch, and we may cancel and refund an order where we reasonably believe it to be fraudulent or where verification is not provided. We do this to protect both you and us, and we will always refund in full where we cancel.

7. Delivery, risk and ownership

Delivery arrangements, costs and timescales are set out in our Shipping and Delivery Policy, which forms part of these terms.

Risk in the goods passes to you when they are delivered to the address you supplied. Ownership passes to you when we have received payment in full.

8. Cancellation, returns and refunds

Your 14-day right to cancel, your rights where goods are faulty, and the process for returning items are set out in our Returns and Refunds Policy, which forms part of these terms.

9. Pre-orders

Where you order an item before its release date, we take payment at the time of ordering to secure your allocation. Release dates are set by the manufacturer and may change. If we cannot fulfil a pre-order, we will tell you and refund you in full.

10. Discount codes and promotions

Unless a promotion says otherwise: one discount code per order; codes cannot be combined; codes have no cash value; codes may be withdrawn at any time; and codes may exclude certain products. We may cancel orders where a code has been obtained or used in a way it was not intended, and we will refund you in full if we do.

11. Your account

If you create an account, keep your login details confidential and tell us promptly if you believe someone else has used them. You are responsible for activity under your account. We may suspend or close an account where these terms have been breached.

12. Acceptable use of the website

You may browse and use this website for your own personal, non-commercial purposes. You must not misuse it — for example by introducing malicious code, attempting to gain unauthorised access, scraping or systematically extracting content, or using it in a way that disrupts it for other users.

13. Intellectual property

The design, text, layout, graphics and photography on this website belong to us or are used with permission, and may not be copied or reused without our written consent.

Pokémon, Pokémon character names, and related marks and artwork are trademarks and copyright of The Pokémon Company, Nintendo, Creatures Inc. and GAME FREAK inc. Other product names and brands referenced on this site belong to their respective owners. HALAL PLUG is an independent retailer. We are not affiliated with, endorsed by, sponsored by or otherwise connected to The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., or any other rights holder whose products we sell. Products are referred to by name solely to identify what we are selling.

14. Third-party links

Our website may link to third-party sites. We do not control them and are not responsible for their content or their handling of your data.

15. Liability

15.1 We are not responsible for any loss or damage that is not reasonably foreseeable or that arises from circumstances outside our reasonable control.

15.2 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law. This includes, without limitation, liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability arising from your statutory rights as a consumer which cannot lawfully be excluded or restricted.

15.3 Subject to clause 15.2, we shall not be liable for:

(a) any loss of profit, revenue, business, business opportunity or anticipated savings;

(b) any loss of reputation, goodwill or business interruption;

(c) any loss that was not reasonably foreseeable at the time the contract was entered into;

(d) any loss arising from your use of the goods for a commercial, business, investment or resale purpose, where such use was not expressly agreed or authorised by us;

(e) any reduction, fluctuation or loss in the market, investment or resale value of any collectible product;

(f) any loss arising from the specific contents, rarity, scarcity, desirability or monetary value of cards, collectibles or other items contained within sealed products, provided that the sealed product supplied was the product ordered and was supplied in accordance with the applicable description;

(g) any loss arising from your decision to purchase, open, retain, trade, sell or otherwise use a collectible product based upon an anticipated future value or return.

15.4 In relation to sealed collectible products, including but not limited to trading card products, booster boxes, booster packs, collection boxes and similar products, you acknowledge that the contents are randomised and that we do not guarantee that any particular card, item, rarity, pull rate, value or combination of contents will be contained within the product unless expressly stated by us in writing.

15.5 Subject always to clause 15.2 and to any rights you have under applicable consumer law, our total aggregate liability to you arising out of or in connection with any individual order shall not exceed the total amount actually paid by you for the goods giving rise to the claim.

15.6 Nothing in these Terms affects your statutory rights as a consumer. Where applicable law gives you rights or remedies that cannot legally be excluded, restricted or limited, those rights and remedies will continue to apply.

15.7 You must take reasonable steps to mitigate any loss or damage for which you seek to hold us responsible. We will not be liable to the extent that your loss or damage could reasonably have been avoided or reduced by taking such steps.

16. Events outside our reasonable control

We are not liable for delay or failure to perform caused by events outside our reasonable control, including supply failures, carrier disruption, industrial action, severe weather and acts of government. We will tell you promptly and, where the delay is substantial, you may cancel and receive a full refund.

Our Privacy Policy explains how we handle your personal data and forms part of these terms.

18. Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it. We will not apply changes retrospectively to orders already placed.

19. General

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. This contract is between you and us; no other person has rights to enforce it.

20. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
